quite funny, doubt neither Notch nor Tod have a hand in this..

Bethesda are suing us, here’s the full story!
A lot of people want more details about what is going on, so here is everything I know:

First of all, I love Bethesda. I assume this nonsense is partly just their lawyers being lawyers, and a result of trademark law being the way it is.

About half a year ago, our lawyers recommended us to register “Minecraft” as a trademark, so we did. I had voted against it initially, but we did it anyway. Better safe than sorry, and all that. At the same time, we also applied for “Scrolls”, the new game we’re working on. We knew of no similarly named games, and we had even googled it to make sure. I’m not even sure if you CAN trademark individual words, like “Scrolls”, but we sent in the application anyway.

(Disclosure: We’ve enforced the trademark for Minecraft once, when there was a minecraft clone on iOS, using our name. People were emailing me saying our iOS version was buggy and bad, so we asked them to change the name of their game, and they did.)

A while later, out of the blue, we got contacted by Bethesda’s lawyers. They wanted to know more about the “Scrolls” trademark we were applying for, and claimed it conflicted with their existing trademark “The Elder Scrolls”. I agree that the word “Scrolls” is part of that trademark, but as a gamer, I have never ever considered that series of (very good) role playing games to be about scrolls in any way, nor was that ever the focal point of neither their marketing nor the public image.
The implication that you could own the right to all individual words within a trademark is also a bit scary. We looked things up and realized they didn’t have much of a case, but we still took it seriously. Nothing about Scrolls is meant to in any way derive from or allude to their games. We suggested a compromise where we’d agree to never put any words in front of “Scrolls”, and instead call sequels and other things something along the lines of “Scrolls - The Banana Expansion”. I’m not sure if they ever got back to us with a reply to this.

Today, I got a 15 page letter from some Swedish lawyer firm, saying they demand us to stop using the name Scrolls, that they will sue us (and have already paid the fee to the Swedish court), and that they demand a pile of money up front before the legal process has even started.

I assume this is all some more or less automated response to us applying for the trademark. I sincerely hope Bethesda isn’t pulling a Tim Langdell.


TL : DR mojang registered the game name Scrolls for their upcoming card? game, and Bethesda lawyers did not like that

I hope this gets thrown out of court, but what about the Dead Sea Scrolls? what about all the pirate films and the use of pirate? I think registering such trademarks is getting out of hand

then there is the Apple case, (Beatles Vs the Apple (Ipod I..... )
to me its getting silly, while I do understand the use of registering names / trademarks, but I think the system is going way too far,

as for Scrolls, I don't see a problem with it, but I don't think the name on its own should be trademarked, "The Elder Scrolls" OK,, its a string of names, but individual names should be free to use
so yeah, hope this gets thrown out of court

Scrolls

Notch has just thrown down the gauntlet on his blog. He wants to settle the Scolls lawsuit with Bethesda once and for all, by beating them in a game of Quake 3.

“I challenge Bethesda to a game of Quake 3. Three of our best warriors against three of your best warriors,” Notch writes. “We select one level, your select the other, we randomize the order. 20 minute matches, highest total frag count per team across both levels wins.”

“If we win, you drop the lawsuit. If you win, we will change the name of Scrolls to something you’re fine with.”

“I am serious, by the way,” he adds.

Even though this could set a quite worrying legal precedent, PC Gamer supports this idea. We hereby offer to help with the administration and refereeing of the event, should Bethesda agree. May the best men win.

To clarify I'm amused by the idea of a three on three, not the whole lawsuit thing thats just plain stupid. As if I would ever confuse 'The Elder Scrolls' with something called 'Scrolls'.

Do they seriously think we're that stupid or something?

Refusing the challenge would have meant that one was niðingr, and could have been sentenced to outlawry. In effect, if the other party was not willing or able to defend their claim, they had no honor.

Yea! IMO its the stupidest lawsuit I've ever heard of, but the battle...LOL.

This is how everything should be settled.

This is one of the things that terrifies me about starting a company. Who knows when some other giant company might decide to sue you for some absurd reason. Even a frivolous lawsuit that has little chance of succeeding still can cost you plenty of money defending against it.

It's not the suits like these that bother me, but the trial lawyers & judges that preside over them.
They're like sharks (even some judges), and are called that for good reason.

The good judges would think about the law in a fair manner and would likely dismiss the suit altogether.
Then you have the sharks that will try it in order to get a piece of money. The lawyer gets his cut, the judge get his/ hers, as does the public court fees, and the litigants get screwed.

I am not a lawyer, but I did read an article by a lawyer who covers gaming news and according to him Bethesda does have a legitimate copy right claim.

With that said Bethesda obviously can choose to enforce this instance or not, and honestly in my opinion this is going to cause more harm than good even if they do win.

That's also a way to get attention and maybe done for selfish reasons.
honestly in my opinion this is going to cause more harm than good even if they do win.
Yes, I wonder if Bethesda missed that ... or are they desperate for attention, too?

To be honest, when I hear Scrolls I thought about "The Elder Scrolls" as well, but that's it.

I see the point in defending the name "The Elder Scrolls", but this is certainly taking it too far and being stupid about it. If it is something different, I doubt people get confused about it.

But the laws have to be somewhat remade I suppose since from what I've seen patents and registered names are mostly used to sue and be protective; i.e. they are more of an obstacle then being benefical. Though, to me this is a really hard one (generally speaking):
Both sides have a good point. On one hand you don't want other to make profit with YOUR invention/name because they "leech" off your publicity and even may harm your trademark, but on the other hand, you want to be able to freely choose your name without running into some artifical obstacles; you could have a product with the same name, but where it's clear it's completly unrelated...
